North Miami Police say they responded on July 20 to the area of Northeast 14th Avenue and Northeast 127th Street for a report of an armed man threatening suicide.

The "armed man" was a 23-year-old autistic patient who had wandered away from a nearby mental health center. He was sitting on the ground, playing with a toy truck.

47 year old behavioral therapist Charles Kinsey, a black man, was attending to the patient.

Multiple cops, armed with rifles, responded to the scene.

Kinsey was hit in the leg by one bullet. A photo shows Kinsey lying on his back with both hands in the air.

Speaking from his hospital bed Wednesday July 20 to a reporter for WSVN TV, Kinsey said "when it hit me I had my hands in the air, and I'm thinking I just got shot! And I'm saying, 'Sir, why did you shoot me?' and his words to me were, 'I don't know'."

The police administered no first aid. "They flipped me over, and I'm faced down in the ground, with cuffs on, waiting on the rescue squad to come", Kinsey said. "I'd say about 20, about 20 minutes it took the rescue squad to get there. And I was like, bleeding."

No gun was found at the scene.

At a Thursday July 21 press conference, the Miami-Dade Police Benevolent Association said the officer was a member of the SWAT team. The head of the PBA told reporters the officer was too far away to hear what Kinsey was saying before he fired.

    Watch, they'll say the police officer is a victim of a weapon malfunction and that no first aid was provided because they were afraid that the man who was shot would get angry.

    This is nothing new. Cops shooting indiscriminately and then making up a back story to explain away their ineptitude.

    The only new thing here is video cameras.

    The cop AND his partner should be arrested immediately for attempted murder, assault with a deadly weapon and accessory to those crimes. I also think the victim should be allowed to shoot each of them in the leg and make them wait 20 minutes for medical aid.

    That wont happen, but I hope he sues the snot out of the cops.

    At best the cop had poor trigger discipline (keep your finger off the damn trigger until you intend to begin firing the weapon). Idiot was probably all afraid and worked up (cuz them blacks is dangerous!) and his finger probably twitched. From the linked article:

    There was a call about a suicidal man with a gun, the officers already heard that. When they arrived they saw two men, Mr. Kinsey and the other individual, the white male, and it appeared to the officers that the white male was trying to do harm to Mr. Kinsey. The officers, realizing and believing that there was a firearm, and many officers thought the white male had a firearm, only much later when we were able to Monday morning quarterback do we find out it was a toy. Only much later do we find out that the individual was autistic. The officers on the scene did not know that. And fearing for Mr. Kinsey’s life, the officer discharged his firearm, trying to save Mr. Kinsey’s life. And he missed, and accidentally struck Mr. Kinsey. He thought the white male and his actions were such that he felt Mr. Kinsey’s life was in danger.

    I don't believe that for a second.

      Yeah, man was lying on the ground with his hands in the air... watch out he might reach down, pull out a gun and shoot the cop before the trained officer realizes anything is happening! Better shoot first, to protect him. Also, that is a really big "miss" for a SWAT trained officer. Like, REALLY big miss.

    He's a SWAT team member, which means he's probably ended up getting straight-up military training. All SWAT teams are para-military in nature (that's a big part of their appeal to cops), but Miami is big enough they're probably getting full-on military training for them. Which is incredibly stupid, since military training is completely incompatible with police training, but this sort of shit has been going on for a long time.

    "I don't know" is beyond pathetic for one sworn to "serve and protect". Minimum charge is attempted murder, official oppression, etc - 30 years, bye-bye.
