The Music Modernization Act is not the law of the land yet, but it's pretty damn close, as the House of Representatives today (Sept. 25) unanimously approved passage of the U.S. Senate's version of the bill, which had itself been approved by that chamber last week. Now, the MMA is off to the White House where it will await the signature of President Donald Trump before becoming the law of the land.

The legislation forged by compromises throughout the music industry creates a blanket mechanical license and a collective to administer it, while changing some of the considerations used in setting music publishing rates. It also compels digital and satellite radio to pay a royalty on pre-1972 master recordings to labels and artists and it codifies the procedure by which SoundExchange can pay producers and engineers royalties for the records it works on.

MMA will update rules regarding royalties and licensing when it comes to streaming in an effort to make sure creators are properly compensated. It will lead to the creation of a publicly-accessible database that makes it easier to see which publishers and artists need to be compensated for particular songs. Further, it will update the royalty rates for artists behind pre-1972 songs and will update royalty rates to reflect market changes all around.

    Waco Alex Jones types that I have known claimed that they did not to pay income tax, because it was signed into law by Abraham Lincoln, who was not born in the United States (actually, he was born in Hawaii, which was not US Territory at the time, but that is another story altogether), and so income tax is unconstitutional.

    So I can imagine that many, perhaps a majority? will maintain that a "law" passed into effect by the mere signature of a "Joke Precedent" (Ref: See UN, as in UN General Assembly Speech, by Trump, the Joke President of the United States of Amerania) is also null and void, and impotent (now), and bald, and rather ignorant of the universe, just like the precedent that signs it. So I, for one, will ignore any and all Trump executive orders, will chase his cabinet members, staff, and Republican Senators out of public dining establishments where ever I find them therein, and I will never respect copyright. The whole concept is just like a Kavanaugh date right now, why should I want be sexually assaulted when I could just pirate the media? The Whole World Wants to Know!

    January 1, 2024. That's when U.S. copyright in the three short films establishing the Mickey Mouse character, as well as the books establishing the Winnie-the-Pooh characters, is set to expire under current law.

    I doubt that the copyright term will be extended yet again. The 1998 extension had the ostensible aim of harmonizing the U.S. copyright term to match that of the European Union, a major trading partner. The Supreme Court in Eldred v. Ashcroft (2003) called this a key reason for upholding the 1998 extension as opposed to finding that the Congress had shown "legislative misbehavior" in two successive extensions. If the Congress were to extend the copyright term a third time before 2024, to what other major trading partner's copyright term would it ostensibly harmonize?

    (Before you answer "Mexico", President Trump doesn't feel very favorable toward trade with Mexico at the moment.)

      First, Trump isn't exactly known for never changing his mind on issues (see e.g. North Korea). Second, it is not at all a given that Trump is still in office in January 1, 2024. There's an election in between, after all.

      Well NAFTA is trying to force longer copyright on some of the signatories and as Mexico already has 100 years, it'll need aligning.

    The world will definitely have changed in the year 3000. We'll have world peace, colonized mars, sent ships to a near habitable solar system, and Mickey Mouse will finally be making it into the Public Domain.
