A 37-year-old Colorado Springs man was cited for discharging a weapon within city limits after shooting his Dell computer 8 times with a 9mm handgun. The police report said that he "was fed up with fighting his computer for the last several months" and shot it in a back alley behind his home. What was not mentioned is exactly why he was so "fed up" with his computer. Could this senseless and violent tragedy have been avoided if his PC were running Linux instead?

    Obviously, this person is mentally unstable and should not be in possession of a firearm. Suppose a ricochet hit someone? What charges would be filed then?

    It's not clear the person was mentally unstable. By analogy, people jump out of planes with parachutes for fun. Clearly they are mentally disturbed. People inhale poisons in the form of tobacco all the time to relax. Clearly they are mentally disturbed.

    I could imagine somebody being so annoyed at something they want the emotional satisfaction of destroying it, especially if it was an old and cheap computer (but even if it was a new and expensive one).

    Suppose a ricochet hit someone? What charges would be filed then?

    I think it's "involuntary manslaughter." And if he breaks a law he should be charged, not just because he could have broken the law. Pretty much everybody in a car could run over somebody by mistake, but I assume you aren't proposing we confiscate all cars.

      You don't spread peanut butter or smooth cement with a gun. It is a weapon, designed to kill. There was no legitimate reason to draw a deadly weapon in this case, and shows a total lack of judgement. This was a deliberate discharge of a weapon, and should be treated as such. Could this hot head shoot a person too, just because they were upset by them?

        That's how most people die because of guns, including suicides. They don't like the target.

        That's why he was cited with "discharging a weapon within city limits", and will presumably be subject to the appropriate punishment according to the relevant ordinance, right?

        People routinely discharge firearms with no intent to kill anything. There are even special places you can go specifically to do that.
