Federal Circuit Court Judge Matthew Myers' decision to grant an injunction to stop the woman from breastfeeding her son comes despite the mother recording negative results on hepatitis and HIV tests. Judge Myers said there was still an unacceptable risk to the baby because the tests were not conclusive.

The case came before the court because the baby's father raised concerns about the mother's tattoo during a bitter parenting dispute.

Chief executive officer Rebecca Naylor said she is worried a dangerous precedent could be set.

The mother, known as Ms Jackson, was ordered to stop breastfeeding her 11-month-old baby by the federal circuit court judge Matthew Myers on 5 June. Myers said there was an unacceptable risk of harm to the baby because the mother could have contracted HIV.

Myers initially told Jackson: “Don’t breastfeed any more. Seriously don’t. It’s not in the best interest of the child. “I seriously want the mother to consider [stopping breastfeeding] before I make an order to prevent it, and I will do it. I don’t care if it hits the front page.”

The father, also 20, had not initially applied for an injunction to stop the woman breastfeeding and the court heard the “genesis” of the idea came from Myers during a custody hearing. Myers could not make an injunction on her breastfeeding based on the woman’s mental health and the court heard he then went looking for an evidence-based reason. “He firmly made up his mind before hearing all of the evidence,” Jackson’s barrister, Claire Cantrall, told the court.

    Only thing worse than a tattooed Australian mother breast feeding, is an Australian father doing the same. Can you imagine? Confrontation comes up, and Crocodile Dundee is all "You call that a teat? This is a teat!"

    [oh, and in general, I am opposed to letting parents harm their children, where they ought to have know. ]
