Derek Chauvin Sentenced to 22.5 Years for George Floyd Murder:

Derek Chauvin, the white former Minneapolis police officer convicted of killing George Floyd, a Black man, was sentenced to 22 and half years in prison Friday.

[...] The 22 1/2-year sentence is 10 years more than the state’s guidelines and Cahill justified the longer sentence citing “aggravating factors”.

In his ruling last month, Cahill found that prosecutors had shown there were four aggravating factors that would allow him to hand down a longer prison term than sentencing guidelines would dictate.

The judge agreed that Chauvin abused his position of trust and authority; that he treated Floyd with particular cruelty by kneeling on his neck for over nine minutes, even as Floyd declared “I can’t breathe”; that he committed the crime as part of a group with three other officers; and that he committed the murder in front of children.

The prosecution had requested Derek Chauvin serve 360 months (30 years) in prison. The defense requested 150 months (12.5 years).

On May 25, 2020, George Floyd, an African-American man, was killed in the Powderhorn community of Minneapolis, Minnesota. While Floyd was handcuffed and lying face down on a city street during an arrest, Derek Chauvin, a white American Minneapolis police officer, kept his knee on the right side of Floyd's neck for 8 minutes and 46 seconds; according to the criminal complaint against Chauvin, 2 minutes and 53 seconds of that time occurred after Floyd became unresponsive.[3][4][5][6][7] Officers Tou Thao, J. The arrest was made after Floyd was accused of using a counterfeit $20 bill at a market.[11] Police said Floyd physically resisted arrest.[12][13] Some media organizations commented that a security camera from a nearby business did not show Floyd resisting.[14][15] The criminal complaint filed later said that based on body camera footage, Floyd repeatedly said he couldn't breathe while standing outside the police car, resisted getting in the car and intentionally fell down.[16][17][18][19] Several bystanders recorded the event on their smartphones, with one video showing Floyd repeating "Please", "I can't breathe", "Mama", and "Don't kill me" being widely circulated on social media platforms and broadcast by the media.[20] While knee-to-neck restraints are allowed in Minnesota under certain circumstances, Chauvin's usage of the technique has been widely criticized by law enforcement experts as excessive.[21][22][23] All four officers were fired the day after the incident.[24]

This has been extensively covered by the media. Some outlets attempt to put their own interpretations on their coverage with their selection of video footage and with their commentary. It is difficult to find a simple video of the incident. Here is one that has coverage from the time of initial encounter of the police the officers with George Floyd up through his being taken away by ambulance. With 385 comments, it was the 5th-most-discussed story in the history of SoylentNews. All four of the officers involved were fired from the police force and are facing charges for the death.

New body-cam footage has come to light, exclusively on DailyMail.com. The two videos there fill in gaps from the previously-released footage.

In light of the interest when we first ran the story, the continuing "Black Lives Matter" protests, and the information this brings to light, I have decided to run this story.

    I'm thrilled that cops can held accountable for being assholes. This sends a signal to cops all over America. Youtube is filled with video of cops being complete assholes, disregarding human rights, and more. This is great.

    But, it looks like Chauvin may be somebody's scapegoat, too. Yeah, they're rationalizing the 22 years pretty well. But, the fact is, few people convicted of 2nd degree murder are sentenced to 22 years these days. Some people convicted of first degree murder don't get sentences that long.

    Seems to me that 12 years would have been about right, maybe 15. 22 is catering to public sentiment, IMO.

        The only good news coming from this is now the hipster faggots who supported BLM are getting shot up by Black people, in their own gentrified neighborhoods like all those people who were shot in Austin, or every other day in Brooklyn when Black people mug the elderly and shoot people with kids at point-blank range. And now, with this court ruling, cops will be even more reluctant to show up when violence kicks off.

      I agree with you about the duration, but that is because I've watched enough about prisons to understand that 10 years in prison is a very long time. I used to hear 10 years in prison and think that it might be too short, but after hearing so much from ex-cons, prison documentaries, prison reform advocates, I believe differently.

      It's not that I believe he deserves less punishment, on the contrary. I just believe the way 22.5 years feels to most people, actually equates out to 10 years in reality.

        I've watched enough about prisons to understand that 10 years in prison is a very long time.

        It pales into insignificance compared to the extra-judicial death sentence Chauvin handed out to Floyd.

        Dead is forever. Chauvin will be free one day. Can't say the same for the guy he murdered. The smirk on his face as he killed Floyd says it all - depraved indifferent.

          All I'm saying is that 10 years in a hellscape like prison is a lot longer than you think it is. It's like telling a 5 year old they have a 5 minute timeout. To them you just murdered them by asking them to sit still for 5 minutes, which is forever in their perception. People outside of prison have this perception that 10 years goes by real fast, when in prison each day is like a year.

          10 years is going to seem like forever to Chauvin, especially being a dirty cop. George Floyd may be dead, but Chauvin is going to wish he was pretty soon.

              I say that to give some of these people that are butthurt by the 22.5 years some much needed perspective.

              Some have brought up how people who have done far less got 15 years using whataboutism. Which is an entirely different discussion, that being the sentences for some not being commensurate with the crime. The example that sticks with me all the time is the man (yes, he was black) that broke into a burger joint and cooked himself some food. He got 15 years which is just extraordinarily excessive. This excessive sentencing doesn't mean we sentence Chauvin to 75 to attempt to balance it out. To me it means we reform the system. I do believe a lot of the excessive sentences happen to minorities.

              All I'm pointing out is that people have a warped perspective of time in prison and think more is less. 22.5 years for Chauvin is effectively a life sentence. Even if he survives, he will get out just in time to live life in diapers.

              22.5 years is a damn long time in prison. It really is.

        22.5 years is too long if he showed any repentance and remorse for what he did, soon after he did it.

        But nope, didn't see any of that. So the more years he is in there the safer those outside are from him.

      Part of what the justice system is for is allowing the community to heal without resorting to lynching the wrongdoer. It always caters to public sentiment, but does so within the legal framework after careful and argumented consideration.

      That somebody are the cops. They are trained to act that way with impunity. They got away with the behavior for so long because, before, there were no camera. Rodney King's case became what it is because of the camera footage from the choppers.

      And that's absolutely no excuse. It's like Eichmann saying "I was just following the order" - i.e., all other cops do the same.

      It's long long overdue, and if Chauvin is the "unlucky" fuck, he can't complain that he is innocent.

        When it comes to injustice, somebody has to be first or it never gets addressed. Too often we get the excuses that it's ok because others do it too.

    A black "male". not black "man". George Floyd was not a man, but a dumb beast. Fuck Chauvin though. He should have had him in the car a long time before he did, and shouldn't have been callously kneeling on him like that for so long. Having said that, the real fault lies with Chauvin's superiors who are throwing him under the bus. "Officers" are taught these tactics and are not held responsible for their day to day actions or regressions in their dealing with suspects/detainees/arrestees. While we live in this multicultural Goy slave colony we should have some basic level of decency. However, Floyd should have been killed before this ever happened. Anyone who sticks a gun to a pregnant lady's stomach should be exterminated as the vermin they are.
    The best place for blacks is Africa. Even if we (whites: the people that foolishly pay all the bills, and created the whole modern world) paid for cruise passage, most wouldn't go without a fight, because they want to leach off Whitey while whining and preying on the weaker whites the whole time. Race/civil war is coming, which is just fine by the international Talmudic Jew, i'm sure.

      Multiple people testified that Chauvin was never trained to restrain a suspect in the manner used. Extensive testimony tells us that once cuffed, a suspect is to be helped into an upright position. Further testimony indicates that all officers are made aware that a suspect with hands cuffed behind will experience breathing difficulties when in the prone position.

      In short, that dog won't hunt.

                      So, you're telling me a number of things.

                      1. Kyle had no right to be in town that night because you say so. Kyle is only as free as you choose to allow him to be, just because.

                      1.a The rioters have rights that Kyle did not, because you haven't condemned them for being in town, with murder and mayhem on their minds.

                      2. Possession of a defensive weapon is enough to convict an American citizen of a crime, the 2nd Amendment notwithstanding.

                      2.a The rioter's possession of weapons appears to be alright in your mind, including the freak who aimed a pistol at Kyle's head.

                      3. If/when you happen to find yourself in a Shit Hits The Fan situation, you're not especially likely to be a survivor.

                            As for the rioters: I have absolutely no problem at all with rioters getting arrested and charged the same way rittenhouse did, you'll note that I haven't said one word in defense of them. I don't actually have the authority to sign permission slips for rioters to go out and be violent so bitching to me about them does nothing more than make your like-minded buddies nod their head vigorously while gibbering about how the law should work in their favor cos they're oh-so-righteous. Neither BLM or Antifa, however, are terms interchangeable with the word 'rioter'. Nobody's defending the rioters, you might have actually seen that by now if you would finally develop a lil bit of sophistication with the terms you're using.

                            When you're really interested in BLM protests ending, and you actually understand what the fuck is going on instead of spouting the regurgitated nonsense that has been refuted a jillion times, you'll become a big fan of doing something to get the cops to cut this shit out. BLM appears when people die, it's a pretty clear pattern. When you say stupid shit like Rittenhouse should get a medal for murder, you're not walking in the direction of things getting better, you're supporting your sports team and perpetuating the game for more innings AND you're weakening the integrity of gun owners in this country. You're gonna need to do a lot better than going "ppl i dont like should be shot!"

                              The first person Rittenhouse shot was running away. Yeah, there was some shouting, that's not an imminent threat. You go to a protest, you expect to get shouted at. There's nothing even to question here. It's a murder.

                              The second shooting is a little more interesting, legally speaking, or morally. Rittenhouse was under attack. Now the reason he was under attack was that he just murdered somebody. Is there a right to self defense if the person you are defending yourself against believes that they are saving innocent bystanders from a potential mass shooter? Or even one who believes (correctly, in this case) that they are apprehending a murderer?

                              Personally I don't think the right to self defense should be so broad. The person who has provoked the violence should not be able to claim self defense. (Well, they can claim it, it just doesn't mean anything). The determination of who provoked the violence is just a question of fact, albeit one that is obvious in this case.

                                Wait, wut? If I understand your first sentence correctly, you've somehow got it upside down. The first person shot by Kyle was aggressively chasing after Kyle - Kyle was the person running away. It was a DEFENSIVE shooting on Kyle's part.

                                Kyle didn't shoot until he ran out of places to run, AND he heard a gunshot, AND his attacker was reaching for his weapon. 100% justifiable on Kyle's part.

                          Yes, intent matters. Rittenhouse clearly had the intent to disengage when he ran away. And Rosenbaum clearly had malicious intent when he chased him down the street and caught him. Huber was trying to bash his head in with a skateboard. Grosskreutz has publicly stated he was trying to shoot him with a pistol. Three clear cases of self-defense.

                          Seriously, have you watched the videos? He is going to be acquitted. If you have seen them, maybe try watching them again, but this time pretend that it is three nasty conservatives chasing and attacking a poor little antifa and see if your perception changes.

    The prosecution had requested Derek Chauvin serve 360 months (30 years) in prison. The defense requested 150 months (12.5 years).

    The defense wanted probation for God's sake. Probation for a murder! In any case, the 22.5 years sentence is just, although in my mind it should have been longer. This cop is going to be in hell for a very long time. He's going to be kept in solitary confinement for his own protection for the foreseeable future. That is hell. Eventually he will be thrown into the general prison population where he will have to fend for himself. That is hell.

      Given what prisons are like, I don't think 20 years is ever just. Anything over about 7 years should be replaced with execution for humanitarian reasons.

      That's not a good answer. A better answer would require redoing the prison system. I'm opposed to capital punishment. But given the current prison system, it seems the lesser evil.

              You'll have no problem getting me to agree that they're stupid, I mean they attempted to execute a 'stop the steal' plan that smarter people pointed out to them LONG before the 6th could not work. However, they were in the building trying to find specific people... targets, and that's a different mission than vandalism.                   I'm not big on that whole "compliance" thing. But, Ashli went too damned far. Whatever crimes others may or may not have committed on Jan 6, Ashli was actively breaking and entering into a secured space, with some number of elected officials sheltering inside. Ashli, as much as anyone, maybe more than anyone, gives credence to that whole "insurrection" story that the left is promoting. It is easy to argue that if Ashli had been permitted inside, she would have been followed by more people, who would actually have attacked those officials inside.

                  Babbit pretty much got what she deserved.

              Lets pretend for a moment that it's the protesters, rather than the police [aljazeera.com], that have killed three people a day for the past year. Even if that were true there is a world of difference between demanding a murderer stand accountable for their actions and trying to overthrow the democratic process.

              The former might be distasteful if you feel killing humans should be legalized but the laters is a direct attempt to destroy our constitution.

                3 people a day. If that is accurate, I'm amazed at such a low number. That includes carjackers, bank robbers, rapists, mass shooters, robbers, and other violent offenders, I presume? 10, or even 20 people per day wouldn't surprise me one bit, to be honest.

                No, I'm not defending the police for every shooting. Cops are often too quick to shoot, and often enough the shooting is unjustified. But, 3 people per day, in a nation of 350 million? Whoop-ti-do.

                Let's be more discriminating, and only prosecute and convict the bad cops. That, and break that "thin blue line" mentality, that pits cops against the world. Fuck the thin blue line - I want cops who are responsible. I want cops who want to send EVERYONE home safely at the end of the day - including petty criminals, and even more serious criminals who don't threaten anyone's lives.

                The color of someone's skin should have zero bearing on how he is treated, either by the cops, or by the community.
