A year and a half ago, we had the strange US Supreme Court case of Timbs v. Indiana where the State of Indiana argued that it was lawful to seize someone's [hypothetical] expensive sports car for going five miles over the speed limit - a position they still hold.

Way back when, Tyson Timbs was arrested and plead guilty to selling heroin (to undercover police officers). They then seized his Land Rover even though it was purchased via an inheritance rather than with drug money. He has been in court ever since to get it back.

Well, despite all that, Timbs got his Land Rover back and it only took him seven years and three different courts (with repeated bouncing around). The State of Indiana has appealed the present ruling by the lowest court to the Indiana Supreme Court which hears this case for the third time.

So why is Indiana fighting this so hard even though they are so clearly in the wrong? Because big money is at stake. My take is that they'll lose a major funding source for their police departments, if they can't steal like this. And that will have to be covered by tax revenue.

    If you don't allow police departments to act like bandits, they will have to trim some fat. Maybe they could only afford to send 2 guys after the next George Floyd instead of 4.

    A friend of mine here in the UK is getting screwed over with this stuff. They are trying to seize his house based on a completely fictitious proceeds of crime amount. As far as I can tell the police are allowed to make up whatever figure they like for the amount of money earned through crime and challenging that in court is hard. He's already pleaded guilty to the crimes but they are now claiming that everything he ever bought for a five year period was as a result of the crimes, including his house. Which is a complete lie but challenging that is difficult and expensive.

    Also another friend of mine was financially ruined when he joined a protest group. He was eventually convicted of some minor trespassing crimes but ended up being liable for the court costs which ended up being several times his annual salary because the council "had to" use one of the most expensive law firms in the country. It was a pretty effective way of stopping middle class people joining in the protest.

        It should have violated some of the due process/excessive punishment laws in the UK. When the US plays those games (for example, here [ij.org]), one at least has the Fourth and Eighth Amendments to fall back on (which enforce due process and excessive punishment respectively).
