The only legal votes are the electoral college. The states elect the president, not the people. If a state wants to use a hotdog eating contest or flip a coin to decide who gets the votes thats up to them.
Eg, Colorado just decided that their votes go to the winner of the national popular vote. Thus rendering their own state irrelevant for campaigning and pork purposes but that is totally legal.

When I said "election day" I was referring to the day whereupon presidential electors are elected. I got no beef with electoral college.

...and by statute, that hot-dog eating contest must occur on the Tuesday following the first Monday in November - not sooner nor later.
