There is still a legal requirement to remove any material that the relevant government has said is unacceptable. To imagine that the fediverse is different is a flaw in your logic. The FBI have seized and closed down fediverse servers (some outside of the US) for making available illegal material. For small servers (perhaps such as ours) the task falls upon the instance manager. Would you want that task? Would you volunteer for it?
Fediverse instances can, and must, have a means of deleting material and accounts.
