New Mexico judge ordered Otero County Commissioner Couy Griffin be removed from office, effective immediately, ruling that the attack on the Capitol was an insurrection and that Griffin’s participation in it disqualified him under Section 3 of the 14th Amendment. This decision marks the first time since 1869 that a court has disqualified a public official under Section 3, and the first time that any court has ruled the events of January 6, 2021 an insurrection.

See? A simple ruling makes all the difference.. go nuts

      Not real sure, but lately the Evangelicals have be shamelessly broadcasting extended excerpts of Fox News propaganda on Christian TV - a worrying sign.     Fusty, did you actually read the ruling or learn anything about the judge who issued that decision? She is a Trump-appointed judge, and there are some massive problems with the decision.

    There might be some justification for screening documents that are protected by attorney-client privilege. I can see that argument. But the argument that the documents should be screened to protect executive privilege is ridiculous. The DOJ is part of the executive branch. This is effectively invoking executive privilege to protect documents from the executive branch. There's nothing in the Constitution about executive privilege. It's a doctrine that's been created by the courts, on the basis that the separation of powers gives the president the ability to refuse some requests for information from other branches of government. Arguing that the separation of powers lets the executive branch withhold documents from the executive branch is nonsensical.

    Then there's the argument about why Trump should get a special master: https://www.nytimes.com/2022/09/05/us/trump-special-master-aileen-cannon.html [nytimes.com]

    Judge Cannon noted that a department report said this had included “medical documents, correspondence related to taxes and accounting information.”

    “In addition to being deprived of potentially significant personal documents, which alone creates a real harm,” she wrote, Mr. Trump faced “an unquantifiable potential harm by way of improper disclosure of sensitive information to the public.” A footnote insinuated that the Justice Department might leak those files to reporters.

    “As a function of plaintiff’s former position as president of the United States, the stigma associated with the subject seizure is in a league of its own,” she wrote. “A future indictment, based to any degree on property that ought to be returned, would result in reputational harm of a decidedly different order of magnitude.”

    Anyone could plausibly suffer serious reputational harm if their private documents were leaked publicly. The judge's justification is that because Trump is a former president, that the harm would be worse, and that this justifies a special master. This is basically saying that because of Trump's power, he deserves special protection under law that the rest of us would not get. The judge doesn't seem to think that you or I would deserve a special master, because we don't have enough power or wealth, and that the reputational harm that we would face isn't enough. This justification is absolutely contrary to giving everyone equal protection under law.

    There's another issue here: https://www.nytimes.com/2022/08/27/us/politics/trump-special-master-judge-cannon.html [nytimes.com]. That article is from August 27, which is before the judge heard arguments from the lawyers representing Trump and the DOJ. Even before hearing any arguments, the judge said that she was inclined to rule that there should be a special master. It is highly unusual to make such statements before a hearing. The judge was not impartial at all, and made no effort to pretend that she was.

    Oh, and there's one more problem with your claim that Democrats erred. It is true that Merrick Garland has to approve actions against Trump that could potentially influence an election, a DOJ policy instituted under William Barr. But the investigation and the legal arguments made to the judge are being handled by career DOJ employees. While these people can and do have their own political views, they are career employees, not political appointees. DOJ lawyers lost in court because of a flimsy ruling by a judge that was not impartial at all.

    Do you have a rebuttal to any of this? Or are you just here to troll? From what I can tell, you come here to bait people with political views on the left. Over on Slashdot, you like to bait people with political views on the right. I've seen you spend plenty of time arguing with smittyoneeach, who is a right-winger whom I've also encountered on a completely different forum. When I see you bait the left here and bait the right at Slashdot, it looks to me like you're trolling.

        If you don't have a rebuttal for what I posted, just say so. I'd respect the honesty, as opposed to your deflection and nonsense about "The Party."

        Once again, it would be highly improper for the Democrats to directly influence the investigation or prosecution into Trump. Sure, there's the January 6 committee, and they can refer potential criminal activity to the DOJ. That's where their influence stops. In free countries, politicians don't get to prosecute their political opponents. The investigation and arguments made in court are handled by career officials at the DOJ, not political appointees. The special master is not about the Democrats, no matter how much you post nonsense about "The Party."

        But you are right about one thing. It was a considerable amount of effort to write that post, and that effort was wasted. I should have known better than to expect an intelligent reply from you.

Janrinok accusing a diwnthread ac of being the OP is pretty shitty and shows how comfortable he is making false accusations in his crusade. By allowing this level of targeting against an annoying user you have allowed ideological bias of any aristarchus-like comment. A staff member regularly posting false accusations is a huge problem, and oddly it is only against liberal users with the convenient aristarchus boogeyman as your excuse.

                              No need to know anything other than I am not aristarchus, and allows me to say without doubt that sharing the same TOR address does not prove identity. Obviously you have some other methods, why nit share with the community in what manner you track them?

                              I am not the only one to name ACs, and I do so with no authority. You doing ao gives official weight, and right now is proving to me how certain you feel while being wrong. Sadly I am no admin of SN so there is no way I can prove anything. This thread has simoly been an exercise in proving how real and misguised admin abuse is around here. I've stuck up for aristarchus, though not his bad behavior, because it was clear there was real abuse. My favorite was finding out this his multi-year ranting about being modblocked was some real fuckery most likely done by the last perl coding admin.

                              Thank you for bothering long enough with this thread, really cements the more vague notions I've been having about SN and some of the community.

                                So let's look at this from another angle.

                                You would have us believe that two people using randomised TOR exit nodes have both responded to each others comments, and not only that but also in a relatively short time frame, and that even the comment preceding this comes from yet another banned aristarchus account (akai.tsubasa) set of IP addresses. Further,that your whole series of comments have changed exit nodes several times but at each time they have 'coincidentally' used an aristarchus IP address? And that this has happened not only on a single day, but repeatedly over several years? Statistically, the odds on that happening are such that it is a most unlikely occurrence. But, for the sake of this discussion, let us assume that it is true....

                                Almost each day, aristarchus creates several more accounts. He then argues that he is not aristarchus but that he is whatever new nicknames he has chosen for his account, as though that makes him suddenly invisible or acceptable to this community. His claims carry no more weight than any AC claiming to be a different person. Aristarchus is banned. The person behind the aristarchus accounts is banned. It is not admin abuse to attempt to control his activities on this site - it is very much part of what we are supposed to do as administrators. It doesn't matter which nickname he uses (out of well over 150 possible account names that he has tried to establish) he is still unwelcome on this site. If his activities are now impacting on other AC users then the responsibility for that rests with aristarchus. You have an easy solution to the problem but you choose not to use it. That is your decision.

                                You are arguing for a completely unregulated site - that cannot exist (as has also been discovered by almost every other social media site) unless the users are prepared to self regulate their activities and conduct. It has been proven on this site, particularly in the past few years, that some users are not prepared to do that. Some still go to great lengths to disrupt stories on the main page. As administrators we have to try to prevent such abuse. If you wish to create such a site then you are welcome to do so and we can give you all the software that you might need. I wish you luck if you choose to follow that path because you could still be held legally responsible for some of the actions of your own community.

                                  Geez Louise you are one salty boomer. Yes coincidently, and I've repeatedly condemned aristarchus' bad actions. Other users misbehaving is not an excuse to abuse others or promote abuse against random ACs because they fit a profile. TOR address space may be theoretically massive, but in reality there are not that many exit nodes. Supposedly you only long term store IP hashes of logged in user's comments, which then means you have no data for whether a TOR address was used over two weeks ago by a true AC. So your base assumption that a TOR address uniquely identifies someone is very flawed. Being not aristarchus I get to assure you that your other tracking measures are also giving you false positives. At this point your mind is clearly made up and no amount of agreeing with your AC ban, even with accepting the stunning hypocrisy, can make a difference. Stay salty asshole, sorry the mean words hurt your feelings.

                                    Wrong - we only store IP addresses for 2 weeks on the server. I have never had access to the true IP addresses. I have no way of converting a hash back to an IP address - many have said it is possible but I do not have such access. However, I genuinely doubt that it is possible because the size of a database that would cover both IP4 and IP6 addresses is bigger than all the storage that we have many times over.

                                    We DO know that an AC has used the associated hash but we do not know which AC used it or when. However, when we have a hash that has been used multiple times by a specific named account which IS kept (but is a hash never used by an AC before) and then is used once or twice by a current AC we can do further analysis.

                                    If you are claiming that it is a coincidence then I cannot categorically prove otherwise. Statistically it seems unlikely but I cannot rule that out. But if that is the case then TOR is much more vulnerable than we are led to believe, because if there are insufficient exit nodes then it is easier to correlate the input and exit of TOR traffic. As I never see the IP addresses I don't know if it is a TOR exit node, VPN, open relay server, or a standard internet connection. But others DO have the ability to do such analysis. I suppose it depends on who you view as the greater threat to your identity. On this site we couldn't care less who or where you are.

                                    The "AC ban" - as you term it - has removed all spamming and the vast majority of the crap posting on the front page stories. It isn't a ban - there are many comments on front page stories that are made anonymously. What is left of the crap posting can be easily managed with moderation. That is all that it was intended to do.

                                    Stay salty asshole, sorry the mean words hurt your feelings.

                                    I am not in the least bit salty, nor have my feelings been hurt. Thank you for feeling sorry for me but it is both unwarranted and unnecessary. If you wish to post as AC then you can continue to do so. And if we have to moderate comments that we believe deserve moderation as part of our administrative role then we will continue to do so. The fix is in your hands but you have the right not to use it. The majority of site users are content to stay private by using a nickname.

                                      Ok buddy, weird for you to clarify about the IP when it was said you store the hash. You even quoted it, so by the law of conservative projection it is safe to say SN records the actual IPs and you likely have easy access to them.                                                 Bans are also meaningless if they are ineffective. First of all, you have to know what you are banning. You have banned the username aristarchus. Well done, janny. Haven't seen that username logged in for some time. But now you are banning the person behind that username? On what basis? He is not banned, because you do not know what it is you are even banning. So it amounts to any comment that says things like the username aristarchus used to say, that you did not like or found disruptive, or too true, and so you ban them as well. This is the textbook definition of censorship. You are hosed, janny!

                        Not true - only those insults used by the former aristarchus - who will, of course, deny everything. It was used by the Anti-Aristarchus account that was subsequently identified as an aristarchus sock puppet,

                        Yes! Veridically NOT true! Neither aristarchus, nor his nemesis, Anti-aristarchus, ever used any of those insults. And Anti-ari was not an aristarchus sock-puppet! Look, it says "anti" right in the username! That means "against" or "opposed", not "identical". Janrinok's sock-radar is seriously miscalibrated, false positives are over ten times the possible true positives! And, none of this is replicable! Where is the peer-review, the actual science?

      The special master appointment will almost certainly be appealed, because the judge has invented totally new legal doctrine. A special master to evaluate attorney client privilege is one thing, but one to evaluate executive privilege is another. Since Trump's whole defense is executive privilege, this is tantamount to putting the special master in charge of determining guilt. This has never been done before and in fact there is no reason that executive privilege should even apply here, since executive privilege belongs to the office of the presidency, not to any person.

      Assuming that the case ends up in the Supreme Court, I would expect a 7-2 or maybe 6-3 decision against Trump. Thomas will side with Trump no matter what, and Kavanaugh and Alito might, but certainly none of the three liberals or Roberts would, and I would not expect Barrett or Gorsuch to. I would think an 8-1 decision would be more likely than a win for Trump.

      I actually kind of hope that it does go to the Supreme Court, which could have an opportunity to restore public confidence in them by issuing a good, legally sound ruling.
