                      President Joe Biden’s administration announced that it would cut Medicare Advantage, after the president has frequently claimed that Republicans want to slash Medicare and Social Security.

      This is worse than a ham sandwich. Manhattan repeatedly passed on even trying to get an indictment despite the ease in getting one. The reason for that is obvious because they are firmly caught up in the height of the establishment via Wall Street. A change like this came directly from the Republican establishment trying everything they can to take out Trump and the earlier the better. They can read the polls for the primary battle and it doesn't look good for them against the modern day Teflon Don because he doesn't care for the rules.

    In bringing the charges, the Manhattan district attorney, Alvin Bragg, is embracing an unusual case that had been investigated by two previous sets of prosecutors, both of which declined to take the politically explosive step of seeking Trump’s indictment.

    This is a huge warning sign that this trial will not be easy.

    Federal prosecutors in New York ultimately charged Cohen [Trump's former lawyer Michael Cohen] in 2018 with violating federal campaign finance laws, arguing that the payments amounted to impermissible help to Trump’s presidential campaign. Cohen pleaded guilty to those charges and unrelated tax evasion counts and served time in federal prison.

    Trump was implicated in court filings as having knowledge of the arrangements, but U.S. prosecutors at the time balked at bringing charges against him. The Justice Department has a longtime policy that it is likely unconstitutional to prosecute a sitting president in federal court.

    Bragg’s predecessor as district attorney, Cyrus Vance Jr., then took up the investigation in 2019. While that probe initially focused on the hush money payments, Vance’s prosecutors moved on to other matters, including an examination of Trump’s business dealings and tax strategies.

    Vance ultimately charged the Trump Organization and its chief financial officer with tax fraud related to fringe benefits paid to some of the company’s top executives.

    The hush money matter became known around the D.A.’s office as the “zombie case,” with prosecutors revisiting it periodically but never opting to bring charges.

    Bragg saw it differently. After the Trump Organization was convicted on the tax fraud charges in December, he brought fresh eyes to the well-worn case, hiring longtime white-collar prosecutor Matthew Colangelo to oversee the probe and convening a new grand jury.

    So we have repeated prosecutors passing over this. And notice the highlighted part with respect to ex-lawyer Michael Cohen. Once again, the guilty plea gimmick rears its ugly head. Cohen pleads guilty to this campaign finance charge and some "unrelated tax evasion counts" and avoids more serious jail time for the latter!

    Lastly, the nearest comparison case appears to be that of former North Carolina Senator John Edwards who had two campaign donors pay off his ex-mistress for almost a million dollars. Even then, Edwards got off [npr.org] with one not guilty and hung jury on the rest.

    We'll see what charges they have and what evidence they rely on. But looks to me like this is one of two long shot trials based on election shenanigans. Of the three government trials I know about, here's my present take on the ranking of difficulty: mishandling of classified documents, this trial, and the Georgia election tampering. There's also other trials [businessinsider.com], particularly a civil rape/defamation trial underway.

        For example, I gave up permanently on CNN when they had a talking head wading on the beach during the Natalee Holloway disappearance because some investigators were diving off the coast nearby. It was more important to be "live" than to report actual news.

      Lastly, the nearest comparison case appears to be that of former North Carolina Senator John Edwards who had two campaign donors pay off his ex-mistress for almost a million dollars. Even then, Edwards got off with one not guilty and hung jury on the rest.

        Meanwhile the New York City/Manhattan DA's office has apparently passed over this multiple times. They have no such alleged policy. As to your last question about giving Trump lifetime immunity, are you suggesting that either? Because otherwise I have yet to run across anyone making such a suggestion.

        It's a classic and often crooked law enforcement maneuver which I have discussed multiple times in the last few years. For example:

        • Nebulous seditious conspiracy [soylentnews.org] from the January 6 protests.
        • Accused of petty crime [soylentnews.org] in Houston, Texas. One usually got less time in the slammer pleading guilty than taking their case to trial and being found innocent.
        • Also from Houston, Texas, 71 drug charges exonerations [soylentnews.org]. In every case, the defendant had plead guilty and was since found innocent by the state.
        • And the people charged with plotting to kidnap the Michigan government failed to be convicted [soylentnews.org] in federal court (2 acquitted and 2 hung jury). The prosecution's case rested on the testimony of four FBI informants/uncover agents and two people who plead guilty to such charges. It should have been a solid case.
        • A guilty plea from Michael Flynn [soylentnews.org] (of the Trump administration) over lying to FBI agents and unlawful communication that was overturned within a year of getting new legal representation.

        Point is that guilty pleas in the US are poisonous. It's way too easy to bully innocent into pleading guilty or for the guilty to plead to exotic charges to avoid punishment for more mundane ones.

        As an aside, I actually found an example of a plea deal that likely wasn't crooked [soylentnews.org]. Runaway wrote in that journal:

        OxyContin maker Purdue Pharma to plead guilty to 3 criminal charges as part of an $8 billion-plus settlement

        [...]

        Guilty pleas? You seldom see that - these corporates always seem to get away with weasel word statements to the effect, "We acknowledge no wrongdoing blah blah blah . . . "

        Imagine if most crooks could normally just plead "we acknowledge no wrongdoing", pay the fines, and move on. There would be a lot less guilty pleas for starters. Actual guilty pleas would be for the most heinous crimes with strong evidence that they couldn't get out of. It would mean something. Though the the "we acknowledge no..." pleas would not.
