Christopher Mims writes at the WSJ that Apple like all ambitious companies occasionally strays from its focus. According to Mims the iPhone is just coming into its prime, the iPad is an immature platform and the iWatch is in its infancy, yet Apple continues to invest in one-of-a-kind feats of engineering like the Mac Pro, which ships in volumes that are a rounding error on pretty much everything else Apple makes. "Something’s got to give," writes Mims. "Showpieces like iMacs with screens that have more pixels than any PC ever (and four times the average selling price of a PC) are impressive, but what is Apple trying to prove? Is it really a good idea for Apple to continue to put resources against being king of a last-century technology?" According to Mims the world’s best tech companies can be the best at two things at once, maybe three and even a company as mighty as Apple gets to be the best at only a handful of things. "In a world in which the cloud is increasingly the hub of everything individuals and businesses do, and our mobile devices its primary avatar, what on Earth is Apple doing running victory laps around a dying PC industry? Personally, I’d rather see Apple push the envelope on what’s next."

Lawsuit Filed Over Domain Name Registered 16 Years Before

Cybersquatting is registering, selling or using a domain name with the intent of profiting from the goodwill of someone else's trademark. It generally refers to the practice of buying up domain names that use the names of existing businesses with the intent to sell the names for a profit to those businesses. Now Andrew Allmann writes at Domain Name Wire that New York company Office Space Solutions, Inc. has filed a cybersquatting lawsuit against Jason Kneen over the domain name WorkBetter.com that Kneen registered in 1999 although Office Space Solutions didn't use the term “Work Better” in commerce until 2015. "Workbetter.com is virtually identical to, and/or confusingly similar to the WORK BETTER Service Mark, which was distinctive at the time that the Defendant renewed and/or updated the registration of workbetter.com," says the lawsuit. But according to an Office Space Solutions’ filing with the USPTO, it didn’t use the term “Work Better” in commerce until 2015. Office Space Solutions is making the argument that the domain name was renewed in bad faith. According to Kneen, Office Space previously tried to purchase the domain name from him and after it failed to acquire the domain name, is now trying to take it via a lawsuit.

Michael Wolff writes in the NYT that online-media revolutionaries once figured they could eat TV’s lunch by stealing TV’s business model with free content supported by advertising but online media is now drowning in free and internet traffic has glutted the ad market, forcing down rates. Digital publishers, from The Guardian to BuzzFeed, can stay ahead only by chasing more traffic — not loyal readers, but millions of passing eyeballs, so fleeting that advertisers naturally pay less and less for them. Meanwhile, the television industry has been steadily weaning itself off advertising — like an addict in recovery, starting a new life built on fees from cable providers and all those monthly credit-card debits from consumers. Today, half of broadcast and cable’s income is non-advertising based. And since adult household members pay the cable bills, TV content has to be grown-up content: “The Sopranos,” “Mad Men,” “Breaking Bad,” “The Wire,” “The Good Wife.”

So how did this tired, postwar technology seize back the crown? Television, not digital media, is mastering the model of the future: Make ’em pay. And the corollary: Make a product that they’ll pay for. BuzzFeed has only its traffic to sell — and can only sell it once. Television shows can be sold again and again, with streaming now a third leg to broadcast and cable, offering a vast new market for licensing and syndication. Television is colonizing the Internet and people still spend more time watching television than they do on the Internet and more time on the Internet watching television. "The fundamental recipe for media success, in other words, is the same as it used to be," concludes Wolff, "a premium product that people pay attention to and pay money for. Credit cards, not eyeballs."

Google Opening Data Center in Former Coal-Fired Power Plant

Quentin Hardy reports at the NY Times that Google just announced that it is opening its 14th data center inside a former coal-fired power plant in Stevenson, Alabama. While there is considerable irony in taking over a coal-burning plant and promoting alternative power, there are pragmatic reasons Google would want to put a $600 million data center in such a facility. These power facilities are typically large and solid structures with good power lines. The Alabama plant is next to a reservoir on the Tennessee River with access to lots of water, which Google uses for cooling its computers. There are also rail lines into the facility, which makes it likely Google can access buried conduits along the tracks to run fiber-optic cable. In Finland, Google rehabilitated a paper mill, and uses seawater for cooling. Salt water is corrosive for standard metal pipes, of course, so Google created a singular cooling system using plastic pipes. Once fully operational, Google's Alabama data center will employ up to 75 employees in a variety of full-time and contractor roles, including computer technicians, engineers, and various food services, maintenance and security roles. "This a fantastic and exciting day for Jackson County," says Jackson County Commission Chair Matthew Hodges.

The Intercept reports that in the aftermath of the NSA’s sweeping surveillance of three French presidents, French Justice Minister Christiane Taubira thinks National Security Agency whistleblower Edward Snowden and WikiLeaks founder Julian Assange might be allowed to settle in France. Taubira was asked about the NSA’s surveillance of three French presidents, disclosed by WikiLeaks this week, and called it an “unspeakable practice.” Taubira's comments echoed those in an editorial in France’s leftist newspaper Libération that France should respond to the U.S.’s “contempt” for its allies by giving Edward Snowden asylum. France would send “a clear and useful message to Washington, by granting this bold whistleblower the asylum to which he is entitled,” wrote editor Laurent Joffrin in an angry editorial titled “Un seul geste” — or “A single gesture.” (google translate) If Paris offers Snowden asylum, it will be joining several other nations who have done so in the past, including Bolivia, Nicaragua and Venezuela. However, Snowden is still waiting in Moscow to hear from almost two dozen other countries where he has requested asylum.

Retuers repots that the US Supreme Court has ruled 6 - 3 in favor of the nationwide availability of tax subsidies that are crucial to the implementation of President Barack Obama's signature healthcare law, handing a major victory to the president. It marked the second time in three years that the high court ruled against a major challenge to the law brought by conservatives seeking to gut it. "Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them," wrote Chief Justice Roberts adding that nationwide availability of the credits is required to "avoid the type of calamitous result that Congress plainly meant to avoid." The ruling will come as a major relief to Obama as he seeks to ensure that his legacy legislative achievement is implemented effectively and survives political and legal attacks before he leaves office in early 2017.

Justice Antonin Scalia took the relatively rare step of reading a summary of his dissenting opinion from the bench. "We really should start calling the law SCOTUScare," said Scalia referencing the court’s earlier decision upholding the constitutionality of the law. SCOTUS is the acronym for the Supreme Court of the United States.

In South Carolina, the governor has called for the Confederate flag to stop flying over the capitol. The governors of Virginia and North Carolina quickly declared that they would remove the flag from state license plates. Meanwhile, several of the country's top retailers -- including eBay and Amazon -- announced in quick succession that they would stop selling Confederate flag merchandise. Now MJ Lee reports at CNN that the debate over the Confederate flag is the most recent and vivid illustration of how changes in the business community can influence and pressure politics. "What you are seeing is a broad, acknowledgment across both the consumer, the political and the business community that that particular emblem is no longer part of something that should be a state-issued emblem," says GOP strategist Scott Jennings.

Walmart, Amazon, eBay and Sears announced within the span of one day that they would ban the sale of Confederate flag merchandise from their stores, saying they had no intention of offending customers. As Walmart CEO Doug McMillon put it, the decision was straightforward: "We want everybody to feel comfortable shopping at Walmart." Corporate and business leaders say that the abandoning the flag is a step towards inclusiveness for a region that has long struggled to shed negative images. "The business community -- they have a lot of say and power all over the country, whether it's on religion or ethnicity or LGBT issues," says Ralph Northam. "When you're running a business, you have to have the doors open and welcome diversity."

Fran Sussner Rodgers writes in the NYT that a little-noticed change in the American workplace is about to occur when later this month the Department of Labor is expected to announce an adjustment to the Fair Labor Standards Act raising the salary threshold for overtime from $23,660 per year to at least double that theshold. In 1975, the last year the threshold was significantly raised, 60 percent of salaried workers fell within the requirement for overtime pay while today, only 8 percent do so the new requirement should be a welcome change for millions of American workers.

But the change also speaks to an issue that affects everyone, whether eligible for overtime or not - the clash between the finite amount of time employees actually have versus the desire of employers to treat time as an inexhaustible resource. Employees in the United States currently work more hours than workers in any of the world’s 10 largest economies except Russia. When everything over 40 hours is free to the employer, the temptation to demand more is almost irresistible. But for most employees, the ones exempt from overtime rules, their managers have little incentive to look for ways to use their time more efficiently. "We are a tired, stressed and overworked nation, which has many negative consequences for our personal health and the care of our children. As a nation, we work harder and longer than almost all of our competitors, and much of that work is uncompensated," writes Rodgers. "Time is our personal currency. We parcel it out, hour by hour, to meet the demands placed on us. We all pay a steep price, as individuals and as a nation, when we can’t meet our most important obligations."

Recycling is Dying

Aaron C. Davis writes in the Washington Post that recycling, once a profitable business for cities and private employers alike, has become a money-sucking enterprise. Almost every recycling facility in the country is running in the red and recyclers say that more than 2,000 municipalities are paying to dispose of their recyclables instead of the other way around. “If people feel that recycling is important — and I think they do, increasingly — then we are talking about a nationwide crisis,” says David Steiner, chief executive of Waste Management, the nation’s largest recycler.

The problem with recylcing is that a storm of falling oil prices, a strong dollar and a weakened economy in China have sent prices for American recyclables plummeting worldwide. Trying to encourage conservation, progressive lawmakers and environmentalists have made matters worse. By pushing to increase recycling rates with bigger and bigger bins — while demanding almost no sorting by consumers — the recycling stream has become increasingly polluted and less valuable, imperiling the economics of the whole system. “We kind of got everyone thinking that recycling was free,” says Bill Moore. “It’s never really been free, and in fact, it’s getting more expensive.”

One big problem is that China doesn't want to buy our garbage anymore. In the past China had sent so many consumer goods to the United States that all the shipping containers were coming back empty. So US companies began stuffing the return-trip containers with recycled cardboard boxes, waste paper and other scrap. China could, in turn, harvest the raw materials. Everyone won. But China has launched "Operation Green Fence" — a policy to prohibit the import of unwashed post-consumer plastics and other "contaminated" waste shipments. In China, containerboard, a common packaging product from recycled American paper, is trading at just over $400 a metric ton, down from nearly $1,000 in 2010. China also needs less recycled newsprint; the last paper mill in Shanghai closed this year. "If the materials we are exporting are so contaminated that they are being rejected by those we sell to," says Valerie Androutsopoulos, "maybe it’s time to take another look at dual stream recycling."

Cliff Zukin writes in the NY Times that those paying close attention to the 2016 election should exercise caution as they read the polls because election polling is in near crisis as statisticians say polls are becoming less reliable. According to Zukin, two trends are driving the increasing unreliability of election and other polling in the United States: the growth of cellphones and the decline in people willing to answer surveys. Coupled, they have made high-quality research much more expensive to do, so there is less of it. This has opened the door for less scientifically based, less well-tested techniques. To top it off, a perennial election polling problem, how to identify “likely voters,” has become even thornier. Today, a majority of people are difficult or impossible to reach on landline phones. One problem is that the 1991 Telephone Consumer Protection Act has been interpreted by the Federal Communications Commission to prohibit the calling of cellphones through automatic dialers, in which calls are passed to live interviewers only after a person picks up the phone. To complete a 1,000-person survey, it’s not unusual to have to dial more than 20,000 random numbers, most of which do not go to actual working telephone numbers. The second unsettling trend are rapidly declining response rates, reaching levels once considered unimaginable. In the late 1970s, pollsters considered an 80 percent response rate acceptable but by 2014 the response rate has fallen to 8 percent. "Our old paradigm has broken down, and we haven’t figured out how to replace it," concludes Zukin. "In short, polls and pollsters are going to be less reliable. We may not even know when we’re off base. What this means for 2016 is anybody’s guess."
