Concerning the regulation of digital communications, and, in connection therewith, creating the digital communications division and the digital communications commission
Session: 2021 Regular Session

Bill Summary

The bill creates the digital communications division (division) . . . On an annual basis and for a reasonable fee determined by the commission, the division shall register digital communications platforms . . . such as social media platforms or media-sharing platforms, that conduct business in Colorado . . . A digital communications platform that fails to register with the division commits a class 2 misdemeanor, punishable by a fine of up to $5,000 for each day that the violation continues.

The division shall investigate and the commission may hold hearings . . .

  • Include practices that promote hate speech; undermine election integrity; disseminate intentional disinformation, conspiracy theories, or fake news; . . . .
  • May include business, political, or social practices that are conducted in a manner that a person aggrieved by the practices can demonstrate are unfair or discriminatory to the aggrieved person. . . . .
  • Practices that target users for purposes of collecting and disseminating users' personal data, including users' sensitive data
  • Profiling users based on their personal data collected
  • Selling or authorizing others to use users' personal data to provide location-based advertising or targeted advertising; or
  • Using facial recognition software and other tracking technology.

    Time, yes, money no. This is such a glaringly obviously unconstitutional bill that finding a lawyer to take the case on contingency would be easier than tying your shoes.

        Got all your permits, paid all the fees? Do you properly display all nutritional information and health hazards?

        You know, in other countries, you can walk around and sell anything you can push, pull, or carry, but in the libertarian USA, you need a license to do anything. What's up with that?

          Hell no! Pirate wieners for everybody!

          Dunno who told you we were still anywhere near libertarian. Congress has been hacking away at that for a couple hundred years and change to great effect. We're just the best alternative currently around.

    You don't want to be involved in a lawsuit. Even if you are right. It is a crap shoot and you don't know what the outcome could be. It isn't some fantasy land where everything works out for the best in the end. Goodness and Righteousness prevails with unicorns and rainbows everywhere. It's a game between lawyers.

        Just doesn't matter if they want to keep you on ice for a while. When a court overrules such things, they should throw the legislators who wrote the statute and voted for it into the pokey for violating the constitution, and maybe even the people that reelected them into office. That should deter this crap.

          Jailing them carries too high of a burden of proof. Just take away their right to cast a vote in congress for the rest of their term or two years, whichever is greater.

            Heh, then you would have a room full of people who can't do anything. You're whittling them down by half or more every time it happens. Gotta get them out of the way, or they pile up and rot
