Background:
Loser Trump Lost. Group of crazies filed baseless lawsuit in Michigan to overturn free elections and put fascist minority in power. Court finds this entire fiasco without merit, baseless with no factual basis. State wants legal costs for this absurd waste of resources. Anyone, everyone whose name is on this lawsuit is scattering like cockroaches. Who? Me? Not I! It was someone else! I swear under plenty of perjury!

(After filing election suits, pro-Trump lawyer L. Lin Wood is asked to undergo mental health evaluation)

Pro-Trump lawyer Lin Wood denies he played role in Michigan election case where he was listed as counsel

  • Pro-Trump attorney Lin Wood said he had virtually nothing to do with an unsuccessful lawsuit in Michigan challenging the results of Joe Biden’s victory over Donald Trump.
  • The remarks came in a hearing on whether to impose sanctions or financial penalties on the plaintiffs and their attorneys, including Sidney Powell, who filed the legal complaint. Wood is listed as counsel in the complaint.
  • The lawsuit in Michigan was one of dozens of failed bids by Trump’s legal team and his allies to reverse his loss to Biden in 2020.

Pro-Trump attorney Lin Wood, who had unsuccessfully challenged the results of President Joe Biden’s 2020 election win in key states, said Monday that he had virtually nothing to do with one such election lawsuit in Michigan, where he was listed as counsel.

How do you get listed as counsel on a lawsuit and not know it?

Wood’s effort to distance himself from that case came in a contentious videoconference where a federal judge considered whether to impose sanctions or financial penalties on the plaintiffs and their attorneys, including pro-Trump “Kraken” lawyer Sidney Powell, who filed the legal complaint in November.

“I did not review any of the documents with respect to the complaint. My name was placed on there, but I had no involvement,” Wood told U.S. District Judge Linda Parker in the virtual hearing.

“I just had no involvement whatsoever with it,” Wood said, adding that he had not been following the litigation and found out about the motion for sanctions through newspaper articles.

But David Fink, a lawyer for the city of Detroit, shot back that Wood had been notified by email and first-class mail and given an opportunity to withdraw from the proceedings in mid-December.

“Any other representation by him is blatantly false,” Fink said.

[....] Powell said she “can’t imagine” she would have added Wood to the lawsuit without his express knowledge.

Yeah, right. And Powell defends herself vs Dominion by saying no reasonable person would have believe any of the lying lies she told because she is a liar whose lies cannot be believed.

Moving on. Let's try a different source.

Trump lawyers might be penalized over Michigan election case

DETROIT (AP) — A federal judge considering whether to order sanctions against some of former President Donald Trump’s lawyers spent hours Monday drilling into details about an unsuccessful lawsuit that challenged Michigan’s 2020 election results.

The lawsuit alleging widespread fraud was eventually dropped after the judge found nothing but “speculation and conjecture” that votes for Trump somehow were destroyed or switched to votes for Joe Biden, who won Michigan by 2.8 percentage points.

Well, that's not a good start.

Democratic Gov. Gretchen Whitmer and the city of Detroit now want the plaintiffs and a raft of attorneys, including Trump allies Sidney Powell and L. Lin Wood, to face the consequences of pursuing what they call frivolous claims, the first effort to wrench fines or other penalties.

“It was never about winning on the merits of the claims, but rather (the) purpose was to undermine the integrity of the election results and the people’s trust in the electoral process and in government,” the attorney general’s office said in a court filing.

[....] There is no evidence of widespread fraud in the 2020 election. Indeed, election officials from both political parties have stated publicly that the election went well, and international observers confirmed there were no serious irregularities.

Why didn't the judges immediately file frivolous lawsuit charges on the first day in addition to legal fees? Why doesn't the DOJ? They let it go way too far. Just keeps Trump in the headlines, exactly where he wants to be. The dems don't mind the distraction either.

:-) Getting a bit sensitive, are we? Didn't say anything about democrat judges. But if they can slam a contempt of court judgement at the drop of a hat, they can do the same for frivolous lawsuits. A contempt charge would be perfectly legitimate in these cases. None were filed. Dragging this out seems to be the intent, as there is much benefit for those involved on to do so.

There is no "due process" in a contempt of court charge because the infraction typically occurs right there in front of the judge. The judge doesn't need a jury to decide if you are being lippy and mouthing off in court. In other instances, the judge has given a specific court order which the defendant blatantly (and often very publicly) decides not to follow (e.g., a gag order). That also does not need due process because the court has already given clear instructions which the defendant has decided to ignore. Or, perhaps more accurately, the judge has already handed down a court order and the defendant has chosen to defy the order. I hope this clarifies for you.

What happened this morning was the sanctions hearing.

      Hear is more news.

Federal judge grills Sidney Powell's legal team in Michigan elections sanctions case [freep.com]

A Michigan federal judge grilled Sidney Powell and her team of lawyers for roughly six hours Monday in response to motions to sanction the attorneys in connection with their conspiracy-laden lawsuit claiming election fraud in the state.

[....] Parker repeatedly questioned whether the attorneys properly investigated the claims of fraud and misconduct presented in affidavits included in the lawsuit before submitting them to the court.

Woah! Wut? Mere claims of fraud and misconduct are supposed to be investigated? Can't we just take Trump's word? Or Fox News' word? It was Dominion and Smartmatic. And the Italians using satellites to flip votes in US voting machines! Why would anyone need to investigate? Just listen to Lou Dobbs.

"My concern is that counsel here has submitted affidavits to suggest and make the public believe that there was something wrong with the election. And that is what this is all about. That's what these affidavits are designed to do, to show that there was something wrong in Michigan, there was something wrong in Wayne County, " Parker said.

Isn't that why they filed this baseless lawsuit without any factual basis? To create a big outrage so people would storm the capitol?

The lawyers largely could not say they spoke with the people who provided the affidavits, something that appeared of concern to Parker, who used phrases such as "shocks me," "a little surprising" and "problematic."

"I think it's wrong for an affidavit to be submitted in support...if there's been no kind of minimal vetting," Parker said.

Wait! What! Affidavits -- and the lawyers haven't even spoken to these people!

In making the argument for sanctions, lawyers for the city of Detroit and Michigan told Parker that imperiling democracy by perpetuating lies about the 2020 presidential election warrants substantial punishment.

"In this case, the very basis of the election of the president of the United States was under attack. These folks were putting in jeopardy the safety of our republic," said David Fink, an attorney for Detroit.

Did you read the things the judge wrote? That is not political bias. This was a frivolous lawsuit for the purposes of announcing it in right wing news media. It has no facts. No basis. If there were some facts, if this were a serious lawsuit, the lawyers who filed this wouldn't all be trying to run away like cockroaches when the light is turned on.

Earlier on requiring Lin Wood to have a mental health evaluation or be disbarred is not a political stunt. Why didn't this get major media coverage on right wing news media? Oh, because the entire thing is as embarrassing as I point out once you actually look beyond the announcement of the lawsuit.

I'm not telling you judges are perfect or impartial. But if something is terribly wrong here, it will be appealed. Furthermore, I would expect Lin Wood, Sidney Powell, et all to be screaming about it rather than running away from it because of the circus it is.

Not investigating the facts alleged in the complaint?

Affidavits without lawyers even talking to those witnesses?

That just doesn't happen in an actual lawsuit.

The taxpayers of Michigan should get their money back for legal costs of this nonsense. Just as taxpayers in Arizona did after the GOP frivolous lawsuits there fully played out. (see some of the links I provided above) Don't bring a lawsuit just for PR purposes. Be prepared to back it up. Especially when alleging something as serious as election fraud that goes to the heart of our democracy.

We are obsessed with past elections when we should be fearful of the next one. Not a bright future ahead.

Isn't the whole point of a lawsuit and trial to find out if a case has merit? Why not save money by doing away with the courts and all that and just "know" what the answer should be?

Your whole journal entry seems to be saying that you should just toss out due process because everybody knows "Orange Man Bad'. If the case has no merit then award costs against the filer.

    It sort of reminds me of;
First they came for the Nazis, and they didn't get a fair trial because everybody knows "Nazis Bad"
Then they came for the Alt-Right, and they didn't get a fair trial because everybody knows "Alt-Right = Nazi"
Then they came for the rest of the Conservatives, and they didn't get a fair trial because everybody knows "Conservative = Alt-Right"
Then they came for the swing voters, and they didn't get a fair trial because by then they were "the most right wing"
Then they came for me, and I didn't get a fair trial because I wasn't Woke enough.

What I did is present links, to news sources, which tell of what happened. Don't blame me for what happened.

This ridiculous case is getting all the due process it deserves.

^ that comment encapsulates the alt-right attitude so well. Mad that their bullshit didn't play out, mad that their whining about fake persecurion is mocked, and eager to punish those who simply disagree. It is kind of like everything they say is a lie projecting their own weaknesses on to others.
