Follow up to yesterday's journal entry:
More fallout of Trump losing the election
Don't blame the judges or the courts. Just look at the antics of the lawyers filing this 'fantastical'* farce.
*fantastical -- the judge's word for it
The latest effort to hold former president Donald Trump and his allies accountable for months of baseless claims about the 2020 election played out Monday in a Michigan courtroom, where a federal judge asked detailed and skeptical questions of several lawyers she is considering imposing sanctions against for filing a lawsuit seeking to overturn the results.
U.S. District Judge Linda V. Parker said she would rule on a request to discipline the lawyers in coming weeks. But over and over again during the more than five-hour hearing, she pointedly pressed the lawyers involved — including Trump allies Sidney Powell and L. Lin Wood — to explain what steps they had taken to ensure their court filings in the case filed last year had been accurate. She appeared astonished by many of their answers.
While their suit aimed to create a broad impression that the vote in Michigan — and specifically Detroit’s Wayne County — had been troubled, the affidavits filed to support those claims included obvious errors, speculation and basic misunderstandings of how elections are generally conducted in the state, Parker said.
“There’s a duty that counsel has that when you’re submitting a sworn statement . . . that you have reviewed it, that you had done some minimal due diligence,” she said.
Blame the judge! Blame the court! It's all political bias!
If Parker decides to discipline the lawyers, she could require them to pay the fees of their opponents in the case, the city of Detroit and Michigan state officials. But she could also go further — assessing additional monetary penalties or recommending grievance proceedings be opened that could result in banning the attorneys from practicing in Michigan or disbarring them altogether.
The Michigan hearing is part of a broad move underway nationally to hold responsible Trump and his backers who spread falsehoods about the election, the so-called “big lie” that led to the violent attack on the U.S. Capitol on Jan. 6.
Let's try another . . .
Parker repeatedly criticized the attorneys as failing to do "minimal" research on the "evidence" they presented as part of their multipronged effort — which Powell called the "Kraken" — to nullify the election results in Michigan, Georgia, Wisconsin, and Arizona.
"The court is concerned that these affidavits were submitted in bad faith," Parker said.
Lin Wood tried to weasel out of this embarrassment . . .
"I did not review any of the documents with respect to the complaint," Wood said, later adding, "I just had no involvement in it whatsoever."
But David Fink, an attorney representing Detroit, contested that claim, saying that Wood had endorsed the effort on social media and that Wood's own lawyer had said he was associated with the case.
On another note. I did not find I had any mod points today. Maybe SN has run out or there is a global shortage? Or perhaps I have offended the local gods by pointing out the big lie.

If there were any truth to something that outrageous, we would all know about it.
It wouldn't be something that only one person knew about and posted online. It would be something that multiple people at multiple levels would know about. And not all of them would keep quiet about it.
When you start talking about a truckload of ballots, this is going to be extremely statistically significant and not jive with the numbers of all of the reporting precincts totals that truckload represents. Something fishy would be obvious. The system is designed this way.
As for Smartmatic and Dominion, these are companies whose entire business is built on making machines that reliably count ballots. When they build the machines, they don't know what elections they will be used in, who is running, what politics they represent, etc. Their business is reliable trustworthy voting. The lawyers could actually interview people being deposed (imagine that!), and lawyers whose name is on the case, would not deny it and scurry away like cockroaches as soon as the light is turned on.
Court cases are not done in secret. (There are exceptions unfortunately.) But most, including this one, are public.
If there were some kid of judicial misconduct here, they could file an emergency appeal. If they were serious.
But they are not serious. This is all for PR value. Fodder for sites such as you linked to. Not for any actual legal process or genuine legal grievance. Just for PR value on crazy web sites. If it weren't so, then they would be serious about this. Have real attorneys. Have their case in order. (imagine that!) Not have depositions where they misconstrue some of what is in the deposition, but the deponent backtracks on what they are saying making clear they don't actually believe it or stand up for it.
You may have noticed how on election day, major media sources (including Fox News for example) seem to have frequently updated vote totals from every single precinct in the entire USA. Their software can zoom in down to a detailed level and show counts within individual cities. And they have this information over time as the election unfolds.
If there were some major manipulation of the vote, like truckloads of ballots, etc, then the totals would not match up. The totals for an entire state would not match what is going on at the local levels. And this could not be hidden from major media sources who have all that information. Once the manipulated totals are in, for a state, you would have FOX, CNN, NBC, ABC, CBS, MSNBC and others all crying foul! They could instantly show that something very major is wrong with those totals.
This holds true even in some backward red states where they discourage the teaching of advanced mathematical skills such as addition.
At the local levels, there are plenty of people who know what the vote totals are. And poll watchers at the local levels. So don't propose some grandiose conspiracy that crosses all local levels, and every single election judge and poll watch (of both parties), and a conspiracy involving both FOX and CNN agreeing not to point out the obvious discrepancy.

I thought more about this.
If this lawsuit were on the up and up, then explain these things.
Normally, your counsel (for whichever side you are on) goes over everything with a person BEFORE they ever go to a deposition. The counsel prepares the witness for all the kinds of questions opposing counsel may ask. But in this case, the lawyers never talked to the people being deposed. It's almost as if this entire proceeding were in bad faith for an improper purpose (Public Relations on right wing media) and not for the reasons stated in the complaint about election fraud.
A witness describes, I saw a postman with a bag. Standing around. I suppose it could have been full of ballots.
None of the plaintiff lawyers seem to have any faith in their own case. And from the deposition, I can see why. They cherry pick things out of the deposition, but ignore things where the witness backtracks or is doubtful about where counsel wants to lead them into swearing to under penalty of perjury.
