MyPillow CEO Mike Lindell still hasn't given a basic response to Dominion's $1.3 billion defamation lawsuit

  • Mike Lindell and his company MyPillow haven't filed answers to Dominion's defamation lawsuit.
  • A judge ruled in August that Dominion's lawsuits against MyPillow, Lindell, Sidney Powell, and Giuliani could proceed.
  • Giuliani and Powell filed responses, but MyPillow and Lindell have dragged their feet.

MyPillow and its CEO Mike Lindell still haven't given the court an answer to the $1.3 billion defamation lawsuit Dominion Voting Systems filed against them in February.

Attorneys for Lindell and his company asked the court to dismiss the case in April, but US District Judge Carl J. Nichols ruled in August that it could proceed.

Since then, Rudy Giuliani and Sidney Powell — the two other 2020 election conspiracy theorists Dominion sued around the same time it sued Lindell — have provided thorough answers to the lawsuits against them.

But MyPillow and Lindell haven't.

This is a good way to get a default multi billion dollar judgement against you real quick.

Another fun story from the past which I didn't bother to write about here. But I wonder if this could be a factor in Lindell not responding to the lawsuit.

Law Firm Quits MyPillow CEO Mike Lindell’s Dominion Lawsuit, Claims Lawyer Filed It Without Permission

An attorney representing MyPillow CEO Mike Lindell in a new lawsuit against voting machine companies Dominion Voting Systems and Smartmatic has departed the law firm Barnes & Thornburg after filing the complaint without its authorization, the firm said in a statement Friday, and it withdrew from the case.

It's a fun story. In a nutshell:

  • Lindell keeps pushing baseless claims alleging widespread election fraud
  • After Dominion's lawsuit against Lindell (and others), Lindell files a counter lawsuit against Dominion
  • The lawyer who filed it, didn't get permission from his firm. Is now fired from firm. The firm has withdrawn from the suit leaving only the attorney attached to the case.

Is this a clown circuis or what?

Lindell, Powell, Guliani, FoxNews, OAN and others all had their free speech. Nobody censored them. Especially the government did not censor them, which is part of what 1A is about. Now the natural consequences of their speech is coming back to bite. The 1A doesn't mean your speech might not have consequences. It only means the government can't stop you from putting your foot in your mouth.

There are deadlines. Not meeting those deadlines (plus any related behavior) are what can trigger the contempt of court. Turmoil like this could result in an extension of those deadlines or it might not. Depends on how the judge feels.

I imagine the judge has built up some degree of impatience or skepticism by this point, but Lindell might get an extension just the same, if his defense really is in that much of a shambles.

The judge may also be more inclined to grant the exception if he believes Lindell doesn't have a case. Losing because his legal team blew up isn't nearly as satisfying as him losing on the merits, and is much harder to appeal. For the record I hope he does get the extension, because win, lose, or draw, only by deciding a case on the merits is justice actually served.

A default judgment is considered to be a ruling on the merits once it is final. It is analogous to a trial where the defense just sits on their ass the whole time and presents no evidence or argument. The court literally has no choice but to rule in the favor of the side that did present evidence. You had your chance and you lost because only the other side presented arguments. But the judge probably won't make the judgment final until after the rest of the parties have their claims resolved.

While default judgement, after due process, is winning; it is not nearly as satisfying as layout out all of the cold hard facts in front of everyone and losing on the merit(lessness) of this ridiculous big lie about the stolen election.

In my stressful life, I depend on MyPillow™ and now a mattress topper, for as close to a good night's sleep as I can get. That's as much as I can now hope for. I suppose a pillow is a simple thing to most, but I'm thankful to have it. Be thankful for every day you get, and every person in it.

No, I didn't say what brand of mattress topper... I couldn't afford the MyPillow™ brand one. I'm sure Mike Lindell isn't bothered by the lost sale, one bit.
